1. Terms of Use

Please read this website legal information carefully before using this site.

THIS AGREEMENT is made on the day of application and becomes legally binding upon payment of your deposit, monthly installment, or program package/fee.

BETWEEN
1) YOU, the participant as detailed in your application.
And
2) GVN Charitable Trust (GVN) whose registered office is 105 High Street, Lower Hutt 5010, a registered Charitable Trust in New Zealand, registration number CC46460.

This is an important document. We have attempted to state the terms of this Agreement in a clear and concise manner, but if there is anything the Participant does not understand or wishes to have explained, the Participant should seek independent advice from a lawyer, Citizens Advice Bureau, Law Centre or other agency.

Agreement for participation in a GVN Program: The term "Program" means any volunteer program, project, conference, trek, challenge, tour, or other activity anywhere throughout the world, arranged by GVN from time to time.

The term "Regular Program" refers to all volunteer programs with the exclusion of: wildlife/marine conservation programs, treks, tours, and fundraising challenges.

By using this site, you signify you have read and accepted these terms of use. If you do not agree to these terms of use, do not use the site.

The materials in this site are provided "as is" and without warranties of any kind either expressed or implied. To the fullest extent permissible and subject and pursuant to applicable law, GVN disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

GVN does not warrant or make any representations regarding the correctness, accuracy, reliability, or otherwise of the materials in this site or the results of their use.

GVN reserves the right to update the Terms of Service at any time.

International travel is inherently risky. By becoming a GVN participant, you acknowledge and accept these risks and those associated with living and working in developing countries. As a participant you must appreciate and understand that some of these activities may be outside of your personal insurance cover. GVN is not liable (to the maximum extent of the law) for any loss or harm you may suffer, including but not limited to loss caused by:

  • delay;
  • bodily injury or death;
  • emotional upset;
  • damage to or loss of property;
  • war or terrorism;
  • natural disasters.

GVN reserves the right to use feedback from volunteers for website material.

The GVN Charitable Trust is not liable for any errors or mistakes made by partner organizations. All disputes are governed by the law of New Zealand.

This site is presented solely for the purpose of promoting GVN services. This site is controlled and operated by GVN from its offices in Lower Hutt, New Zealand. GVN makes no representation that materials in the site are appropriate or available for us in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local law are applicable.

2. Payments

Application Fee

There is a $250 application fee for each program. Fees are subject to change; as such GVN will seek to provide applicants a seven day notice period of any change to fees.

Program Package/Fees (including deposits)

Details of the Program Package/Fees and their inclusions/exclusions are listed on the GVN website. Fees are subject to change, as such GVN will seek to provide applicants a seven day notice period of any change to fees.

We reserve the right to revise the program fee. All program fee revisions will be announced at least seven days in advance via the website. Program fees are due 8 weeks prior to the 1st of the month volunteers are due to start. Failure to make payment by this time may result in loss of placement.

All payments made to GVN will be acknowledged within two business days of receipt. Online payments will show a charge to GVN Charitable Trust. All online payments are processed through a secure third party site which do not provide GVN with sensitive information such as credit card details.

Program fee payments for regular programs are valid at the quoted price for 12 months from the date of payment. If transferring/postponing a placement beyond this 12 month period, current pricing will apply and the Participant will be required to pay any difference in fees. Program fee payments for wildlife programs, treks, or special tours are subject to change whenever a placement is transferred or postponed.

All transfers/postponements must be undertaken within a three year period from date of payment in line with these Terms of Service.

Nepal Recovery and Rebuild Program

Volunteers launching an online fundraiser through Classy for the Nepal Recovery and Rebuild Program do so on the understanding that US$500 minimum raise will give them priority placement. As at 28.04.2015 a 2-week placement in the Recovery and Rebuild Program is estimated to cost US$1,500 excluding flights. Accurate costs and inclusions will be provided when placement dates are finalised. Donations to the online fundraiser are non-refundable. Where the fundraiser/volunteer decides not to go to Nepal, the funds raised may be allocated as a scholarship to other volunteers to Nepal at GVN's discretion.

3. Refund Policy

3.1. Statute of Limitation

GVN has a one year statute of limitation on refund requests. The one year period begins on the date of fee payment.

3.2. Donations

All donations/payments made via the Classy online fundraising platform are non-refundable, as per the Classy Terms and Conditions.

3.3 Application Fee

The application fee is non-refundable, however is fully transferable to another GVN program providing flexibility to transfer or postpone your placement with a three year period from the date of payment.

3.4. Program Package/Fee

Seventy percent (70%) of the Program Package (fee) is refundable (excluding any non-refundable amounts, eg deposit/Classy donations) until two calendar months before the 1st of the month you are due to begin your program. For example a volunteer with 15 August 2015 as their start date would need to submit their refund request form by the last day of May 2015 to be eligible for a refund.

The program fee is non-refundable in situations where a program is interrupted and/or cancelled during a placement, due to circumstances beyond GVN's control.

All requests for program fee refunds must be faxed, posted, or scanned as an e-mail attachment to the GVN Charitable Trust with your signature at the bottom. Phone calls and e-mails are not acceptable. You will be notified of GVN Charitable Trust receiving your refund request form within two working days. Should you not be emailed in regards to your request, the assumption should be made that the request form was not received. GVN Charitable Trust not responsible for email, fax or mail that is not received.

Refunds are only issued on the Tuesday of each week. Once your refund has been processed you will receive confirmation of the refund being issued.

GVN can refund no more than 10% of the total number of program fees received in any given month. For example, out of 80 program fees received the first 8 approved refund requests would be automatically refunded. Subsequent refunds are processed in the following month in order of the date they were requested.

Program fees paid through GVN Charitable Trust by means of bank or wire transfer will need to have the transaction costs covered by the payee.

3.5. Program Deposits

Program Deposits are fully transferable, however non-refundable (refer clause 3.7. Program Transfer or Postponement for details).

3.6. Cancellations

Regular Volunteer Programs, Treks, Tours, Challenges

The program fee is non-refundable in situations where a program is interrupted and/or cancelled during a placement, because of Force Majeure (ie due to any circumstances beyond GVN's reasonable control, including but not limited to Acts of God, war, acts of terrorism, riot or civil commotion, fire, strike and government or other official intervention).

In the case where a program is cancelled/closed impacting on your ability to begin on your confirmed start date because of Force Majeure (ie due to any circumstances beyond GVN's reasonable control as outlined above), GVN will seek to find another placement within our programs for you.

3.7. Program Transfer or Postponement

Regular Volunteer Programs

The Program Fee/Package is fully transferable to another GVN program providing flexibility to transfer or postpone your placement with a three year period from the date of payment.

Requests to transfer/postpone your placement must be made in writing two calendar months before the 1st of the month you are due to begin your placement. For example a volunteer with 15 August 2015 as their start date would need to submit their transfer/postponement request by the last day of May 2015 to be eligible.

Program fee payments for regular programs are valid at the quoted price for 12 months from the date of payment. If transferring/postponing a placement beyond this 12 month period, current pricing will apply and the Participant will be required to pay any difference in fees. Program fee payments for wildlife, marine conservation, Fiji programs, treks, or special tours are subject to change whenever placement is transferred or postponed.

3.7. Fundraising Challenges and Childrens' Fund Fee (eg Treks and Cycle)

Children's Fund Fee (donation)

All Children's Fund Fees are non-refundable. (This refers to the donation/fundraising portion of the Challenges.)

Challenge Deposits

All deposits for the Fundraising Challenges (Treks and Cycle) are non-refundable unless specified otherwise.

Trek/Cycle Challenge Fee

The Challenge Fee (ie Trek Fee or Cycle Fee) is transferrable to another GVN program, however is non-refundable.

Requests to transfer/postpone your Trek/Cycle Challenge placement must be made in writing three calendar months before the 1st of the month you are due to begin your Trek/Challenge. The current pricing of the program you are transferring to will apply and any difference in fee/package will need to be paid. All transfers/postponements must be undertaken within a three year period from date of payment.

Any Trek/Challenge fees paid directly to our partner organizations are non-refundable.

Where a Trek/Challenge is interrupted or cancelled during the event due to circumstances beyond GVN's control, fees are non-refundable.

3.8. Insurance

The AHI insurance policy offered by GVN is refundable until 21 days before your policy begins. All refunds will be made less the costs incurred in processing the refund such as bank charges plus a GVN processing Fee (US$20).

The policy holder must notify GVN Insurance ( [email protected] ) in writing of any policy changes/cancellations 21 days before the policy begins.

All requests for insurance refunds must be faxed or posted to the GVN Charitable Trust with your signature at the bottom. Phone calls and e-mails are not acceptable. You will be notified of GVN Charitable Trust receiving your application for a refund of the insurance policy within two working days. Should you not be emailed in regards to your request the assumption should be made that the request form was not received. The Duty of Disclosure is the responsibility of the policy holder.

4. Participant's Obligations

To ensure the safety and well-being of participants, partner organizations and the communities they work with, Participants are expected to abide by their program's Code of Conduct. (Please refer your Program Guide for details.)

By participating in a GVN program the Participant accepts that he/she will be subjected to various physical and emotional demands. Participants are aware and accept that the standard of living, including food, hygiene and accommodation in the relevant country may be below the general standards of their own country.

The Participant is responsible for his/her own travel arrangements, expenses and insurance during the Program. The Participant is obliged to secure travel and medical insurance to protect the Participant against losses caused by travel arrangement cancellation, loss or damage of baggage, non-refundable airfare, emergency medical expenses, or emergency evacuation if required.

The Participant represents and warrants that all information and records provided to GVN relating to the Participant, the Participant's medical history and the Participant's medical statement are accurate and truthful and provide GVI with a clear indication of the Participant's state of health. The Participant agrees to notify GVN of any changes to their physical and/or medical condition after the Participant's signing of this Agreement.

The Participant acknowledges and agrees that GVN reserves the right to accept or reject any person as a Participant at any time, or to require a Participant to withdraw from a Program at any time if it is determined in a Program Leader's sole discretion that it is the best interest of the Participant's health and safety, and/or in the best interest of the Program in general.

5. Promotions

GVN / GVNF promotions (eg discounts, vouchers, etc) cannot be exchanged for cash. Only one promotion may be used per placement.

$350 Voucher

Volunteers who pay the Full Cover program package will receive a US$350 voucher after the completion of their volunteer placement. This voucher may be used towards a new program package for the owner or gifted to another volunteer of their choice. The voucher is valid for the life of the original volunteer's application.

In order to redeem the voucher, the original recipient will need to inform GVN of the VID number on their voucher as well as the name of the person redeeming the voucher. The $350 voucher cannot be used in conjunction with any other promotion and/or discount. (eg group fee, 'Bring a Friend', etc). Where a program fee has been refunded, the $350 voucher becomes invalid.

6. Communication

Email

Emails from GVN staff contain information intended solely for the addressee, which is confidential or private in nature. If you are not the intended recipient, you may not peruse, use, disseminate, distribute or copy this message or any file attached to this message. Any such unauthorised use, is prohibited and may be unlawful. If you have received an email from GVN in error, please notify the sender immediately by e-mail and thereafter delete the original message from your machine. Furthermore, the information contained in the email, and any attachments thereto, is for information purposes only and may contain the personal views and opinions of the author, which are not necessarily the views and opinions of GVN Charitable Trust, or any of its associated entities ("GVN Foundation "). GVN Charitable Trust therefore does not accept liability for any claims, loss or damages of whatsoever nature, arising as a result of the reliance on such information by anyone. Whilst all reasonable steps are taken to ensure the accuracy and integrity of information transmitted electronically and to preserve the confidentiality thereof, GVN Charitable Trust accepts no liability or responsibility whatsoever if information or data is, for whatsoever reason, incorrect, corrupted or does not reach its intended destination.

Voice Broadcasts, Text Messaging, Phone Calls

In applying to volunteer you agree to our terms of service which include receiving automated voice broadcasts, text messages, and phone calls from GVN.

Required Documentation

GVN requires certain information from volunteers throughout the process leading up to program arrival. This may include details about the volunteer's skills and experience, a police clearance, legal waiver, etc. If this information is not submitted or reveals a volunteer's lack of suitability for the program, GVN reserves the right to halt the placement process until satisfactory changes are made. If the necessary changes cannot be made, this may result in loss of placement.

7. Privacy Policy

Online Payments

All online payments are processed through a secure third party site who do not provide GVN with sensitive information such as credit card details.

Newsletter(s)

If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. If you do not wish to receive the newsletter, we provide a link on each newsletter that allows you to unsubscribe.

Application Form

Information provided in the online application forms and extra details forms is collected solely for internal use within GVN and its partner organizations. Your e-mail and details such as home country will be passed onto volunteers who are in the same group as you, allowing you to make contact before you meet. If you would prefer that this did not happen, please let us know.

Statistical Information

We gather certain statistical information about visitors to our website, including IP addresses, browser type, ISP, referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users' movements around the site and to gather demographic information about our user base as a whole. This data is collected solely for internal use within GVN

8. GVN RSS Feed: Standard Licence Terms for Using Feeds on Your Site

By downloading a GVN RSS Feed from the GVN Charitable Trust ("GVN") website you agree to be bound by the terms set out below (the "Standard Licence Terms"). These Standard Licence Terms may be updated by GVN from time to time. Please review these Standard Licence Terms each time you download a GVN Feed. Your download and/or use of a GVN Feed indicates your agreement to these Standard Licence Terms.

Subject to the terms of this Agreement, GVN grants you a non-transferable, non-sublicensable, royalty free non-exclusive licence to display on your website GVN content that you specifically select to receive via the GVN Feed. All title, ownership rights and intellectual property rights in and to the GVN Feed shall remain the property of the GVN. You acknowledge that the GVN has absolute editorial control over all GVN Content and you accept that the GVN is editorially independent and that the editorial integrity of the GVN Content is the sole responsibility of GVN.

Excluded Websites

You may not use the Feed or display any GVN Content on any Site that is a web site that is excluded by GVN. Web sites excluded by GVN are any sites that contain material which is libellous, defamatory, pornographic, misleading, or obscene, any site which brings GVN into disrepute, or any site which promotes discrimination, violence, or illegal activity.

Accreditation

You must ensure that all GVN content on your site has an accreditation to the GVN website. Where possible you must create a functional link back to the GVN News story(ies) summarised by the GVN Content; if this is not possible, you must display on-screen the URL from which the GVN content can be obtained. You may not directly or indirectly change, edit, add to or produce summaries of the GVN Content or any content on the GVN website nor place any full-story GVN content in an HTML frame-set.

Accreditation Guidelines

Any GVN RSS feed or GVN content on your site must incorporate an attribution (credit) to the GVN in one of the following forms:

  • "From Global Volunteer Network / www.globalvolunteernetwork.org" (delete as applicable), or
  • "This content / article is from Global Volunteer Network Website"

If you are displaying a GVN RSS feed in a context where a functional link back to the article on the GVN's website is not possible then you must use the following attribution (credit)

  • "From www.globalvolunteernetwork.org"

You may not use any GVN logo or other GVN trademark without explicit permission from GVN.

Warranties and Liability

The GVN Feed is made available by the GVN on an "as is" and "as available" basis and the GVN gives no warranty of any kind in relation to the GVN Feed, the GVN Content, or any content on the GVN website. The GVN disclaims all implied warranties, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, and accuracy regarding the GVN Content, the GVN Feed and the GVN website and any content thereon. GVN excludes all liability for any loss or damage arising in relation to the GVN feed, GVN content, any virus or other contamination, or any unavailability of GVN content.
